Cosmetics & Personal Care

Our internationally-renowned Cosmetics and Personal Care team advises on every stage of the product life-cycle.

Our Cosmetics and Personal Care team members enjoy an international reputation, and are proud to have represented a wide range of companies on contentious and non-contentious matters touching on every stage of the product life-cycle.

Several members of the group have previously held in-house positions within the closely-related pharmaceuticals industry, and we actively leverage this experience across the group. Many aspects of the modern cosmetics and personal care industry mirror those of traditional pharmaceuticals industry. Both incorporate synthetic and/or natural active ingredients into formulations employing a wide range of excipients and carriers. Recent blurring of the line between cosmetic and pharmaceutical uses means increasing onset of regulation.

We work regularly alongside in-house legal counsel, and are equally comfortable directly liaising with colleagues in R&D, Business Development, Regulatory and Commercial affairs.

Our attorneys and solicitors have significant experience in advising on all types of IP issues relevant to the cosmetics and personal care sector, and have appropriate scientific qualifications, e.g. in chemistry and biotechnology. Our IP work includes the use of patents to provide technical and commercial information, world-wide patent and trade mark filing and prosecution, advising on brand names and logos, and design (e.g. packaging) protection and enforcement. We also have a litigation team to act in and support contentious work. Across the whole IP arena, we provide commercially-appropriate advice on infringement and validity, licensing opportunities and business development projects.

We are active in the cosmetics field and are able to work with a wide range of technologies from traditional through to the new, natural cosmetics and personal care compositions, including manufacturing and extraction processes, formulation techniques and International Cosmetic Ingredient (INCI) ingredients, and packaging.

Some of the products our team members have advised on include:

  • Lip sticks, lip glosses and lip balms
  • Skin creams, lotions, and topical ingredients
  • Hair products – shampoos, conditioners
  • Hair colourants and dyes
  • Mascara and mascara applicators

We represent clients from around the world, including Australia, Canada, China, Germany, India, Israel, Japan, New Zealand, Portugal, South Korea, the UK and the US.
